Any charges calculated in respect of any failure to install Half Hourly Metering by the completion of the SP04 Exclusion Period (the “SP04 Completion Date”), then: (a) where the SP04 Completion Date falls on or after the Relevant Implementation Date of The Code Modification that first made reference to 100 kW Metering Systems; (b) such charges shall be calculated in accordance with the rules introduced by The Code Modification that first made reference to 100 kW Metering Systems; has the meaning given to that term in paragraph 3.5.3 of Annex S-1;
