This page outlines the process of removing the Qualified Status of a Party Agent. The Removal of Qualification process (RoQ) forms part of the preventive technique within the performance assurance process.

This process assures that the Qualified Person’s systems and processes (developed outside of BSC Central Systems control) are meeting the required standards set out in the Balancing and Settlement Code (BSC).

How it relates to you

Qualified Persons subject to the RoQ process are listed below:

  • Half Hourly and Non Half Hourly Data Collectors
  • Half Hourly and Non Half Hourly Data Aggregators
  • Half Hourly and Non Half Hourly Meter Operators and CVA Meter Operators
  • Meter Administrators

The Performance Assurance Board (PAB) can remove a Qualified Person’s Qualification if the organisation fails to comply with certain requirements and standards of the BSC.

Exceptions

BSC Parties are not subject to Removal of Qualification; however, significant or persistent breaches of the BSC are addressed under the Breach and Default provisions of the BSC.

Removal of Qualification process

The Performance Assurance Board (PAB) can remove a Qualified Person’s Qualification if the Qualified Person fails to comply with certain requirements and standards of the code. Error and Failure Resolution (EFR) and all escalation steps within BSCP538 must be completed before the RoQ process can be initiated.

  • Once PAB approves the RoQ process, Elexon collects performance history of the Qualified Person from relevant sources, e.g. the BSC Auditor or the Technical Assurance Agent, and present it to the PAB. The Qualified Person can provide some justification for PAB’s consideration if they wish.
  • After considering the information, the PAB may decide to continue with the RoQ process or agree appropriate rectification plans with the Qualified Person.
  • If PAB’s decision is to proceed with RoQ, Elexon will inform the industry that the Qualified Person no longer hold its Qualified status and remove the Qualified Person’s details from the Central Systems.
  • If PAB decides to agree to the Qualified Person’s rectification plan, Elexon continues monitoring progress against the rectification plan and report to the PAB.

A Qualified Person is in the RoQ process until either:

  • It achieves the performance standards or compliance requirements agreed with the PAB
    or
  • The PAB decides to remove its Qualified Status

The organisation is not prevented from submitting a new Qualification application. This should only be done once systems and processes have been improved to meet the requirements set by PAB.

If an organisation’s Qualification is removed, it cannot operate in its previously Qualified capacity. It cannot be the appointed Agent for any Metering System in that role.

If a Supplier appoints an agent that is not Qualified, the Supplier is in breach of the BSC.
