Consultation: Governance Arrangements for the Market Facilitator

The market facilitator will play a crucial role in managing and coordinating distributed flexibility services, when it goes live at the end of this year.
This consultation aims to gather feedback on the proposed market facilitator governance arrangements to ensure effective operation and alignment with industry needs.

Purpose of the consultation
This consultation seeks stakeholder feedback on the proposed enduring governance arrangements for the market facilitator:
Specifically, the consultation invites views on the following:
- approach to cost recovery, budgeting and finance
- how we plan and manage the market facilitator’s activities each year, via a delivery plan and annual delivery schedule
- role in monitoring and reporting on DNO’s and NESO’s progress in implementing the flexibility market rules
- proposed process for amending the flexibility market rules and market facilitator governance arrangements
- proposed structure and maintenance of the flexibility market rules
- role, remit and composition of the stakeholder advisory board
- interactions with NESO and DSOs where changes impact their responsibilities or legal obligations
- overall alignment with Ofgem’s expectations for the market facilitator role.
Background to the proposals
This consultation builds on the outcomes of seven industry workshops held between November 2024 and March 2025, which brought together representatives from Distribution Network Operators (DNOs), the National Energy System Operator (NESO), flexibility service providers, enabling technology providers, and regulatory bodies. These discussions have informed the proposals for an enduring governance framework that will support the development and implementation of the enduring market facilitator governance documents, including the flexibility market rules framework.
