What is the issue?
At CMAG Meeting 21, it was highlighted that CM Rules Exhibit C ‘Form of Certificate of Conduct’ includes a confidentiality restriction and list of parties that CM Participants can reveal CM Confidential Information to. The list includes the EMR Delivery Body but not the CM Settlement Body or Department for Energy Security and Net Zero. However, the CM Rules may require CM Participants to share information with both CMSB and DESNZ.
Rule 5.13 ‘Prohibited Activities’ outlines information that should not be shared, and restricted between CM Participants, to prevent market manipulation.
What is the proposed solution?
This change proposal seeks to update the definition of Capacity Market Confidential Information to clarify that it concerns information that when shared would constitute a ‘Prohibited Activity’ as stated in Rule 5.13.

Activities in this stage may include the development of possible solution options, the development of legal text for a proposal and/or the consideration of the impacts of a solution on relevant stakeholders.
