Modification P382 raised in preparation for a ‘no deal’ Brexit
On Monday 4 March, National Grid ESO raised BSC Modification P382 ‘Amendments to the BSC to Reflect the United Kingdom’s Withdrawal from the European Union Without a Deal’.
Removing ambiguity in the BSC
The Modification P382 proposes that the BSC is amended to reflect where EU regulations will not be retained in EU law in the event of a ‘no deal’ Brexit, to remove any potential confusion or ambiguity from the BSC.
In the case of a ‘no deal’ Brexit, further changes to the BSC may also be required, such as amendments for the Project TERRE changes (P344). This will become apparent as the UK’s relationship with the EU evolves after exit.
Next steps for P382
We are currently drafting the Initial Written Assessment (IWA) for P382 and will publish this on the P382 page of our website on 7 March 2019.
The BSC Panel will consider the IWA at its meeting on 14 March 2019 where it will agree how to progress this Modification. We will recommend that P382 should progress directly to the Report Phase.
Our contingency planning
We have been undertaking contingency planning to respond to all potential eventualities as a result of the Brexit negotiations, and the UK’s subsequent withdrawal from the European Union in March 2019.
Regardless of the final outcome, we are making the necessary preparations to ensure that we make the required amendments to the BSC, in line with the legislative changes.
